Certain Limits on Deportation

The World Assembly,
Recognising that areas recovering from the impact of recent disasters are likely to face resource demands that leave them unable to deal with the arrival of deportees,
Remaining respectful of the right of nations to deport unwanted persons from their sovereign territory,
Seeking to establish a harmonious balance between the national sovereignty of all parties:
1.
Prohibits the deportation of any person to any nation currently undergoing declared disaster preparation or relief efforts or in a state of humanitarian crisis, as recognised by the International Humanitarian Aid Coordination Committee or otherwise relevant international NGOs, excepting:
- when themselves in a state of internationally recognised disaster recovery and where the failure to execute such a deportation would exacerbate their own internal recovery efforts;
- where the failure to execute such a deportation would foment civil strife and political discord to such an extent that it would precipitate a humanitarian crisis;
- prisoners of war and civilian internees, to be processed according to the principles established by any relevant WA Resolutions, and other agreements by state parties;
2.
Further prohibits the deportation of persons in such a manner that would unnecessarily create or exacerbate a humanitarian crisis in the sovereign territory of another member nation, excepting where that nation has freely, expressly, and without being subject to threat of withholding of aid, accepted such a transfer of persons, subject to any necessary international oversight;
3.
Permits nations to grant voluntary repatriation requests to such nations, in accordance with international law and subject to scrutiny that the person being rendered is not subject to coercion;
4.
Emphasises that this Resolution places no restrictions on the rights of nations to otherwise deport persons in accordance with international law
Delegate's Opinion: I surprisingly enjoy this one... And in this case it is all about protecting everyone's national sovereignty... I think that the author of this proposal summed it up amazingly in the following sentence:

"The national sovereignty of each nation in the world is contingent on an equal respect by other nations. It is what "Rights and Duties..." makes clear, and it is a central precept of World Assembly membership. If you are unwilling to respect another nation's sovereignty to the point where you would willingly exacerbate recovery from a humanitarian disaster - this proposal wouldn't even prohibit you from subsequently extracting compensation from them for the cost of temporarily detaining such a person - then you are advocating policies so wildly aggressive they border on 'rogue state' classification."
