  1.1 This shall be titled Fundamental Laws Amendment V
2. Amendments
  2.1 Under article Five, Declaration of Rights, the following shall be added:
 

  8. No citizen shall stand trial for a crime, if the act was not criminalized prior to committing the act.

BTW I did edit it slightly, although this only changes the number due to the fact that there are Four Current amendments thus the number had to be changed to reflect that.

While I partially agree with both sides, and consider the argument of "they might have acted differently if they knew it was illegal", I dislike it, as these people were still doing something illegal, and the fact that they did such things is not excused by the lack of a legal code.

I would like to explain this. It's not because there is a lack of a legal code, however in real life this is how most countries act. Even in the US constitution it is stated that no man shall stand trial for something they did if it wasn't illegal at the time of doing it. No one should be punished for something they did if we didn't outlaw it first. Because we haven't brought up a legal code until now, it's our fault, not theirs, that we have a lack of a legal code.

It's entirely logical to have this as a law - otherwise, what prevents a law being passed making it illegal to discuss, say, cars, and then you all getting banned because there was a debate about someone's new car 5 months ago.

Sensible precaution, although hopefully never needed.

I really don't think it's right to be able to be charged for crime if it wasn't a crime when I (or someone else) performed a certain action. Afterall, if it wasn't illegal, how should I (or someone else) know to expect to be charged for it?
