Citizenship Status, Revocation, and all that Jazz

  • Alright, so in response to some of the issues that have arisen, I have written up some ideas regarding this.

    First off here is what I think should be added/changed, and opening this up for discussion on these ideas.

    On Revocations
    First I should point out that the Storting retains authority over Citizenship, which is then granted to the Monarchy as it is more effective to do so. Now, here is my idea as to changes in this area:
    • Appeals on Revocations should have a three month appeals period (perhaps with an exception for extenuating circumstances: ie get hit by a car and end up in a coma for four months the day after your citizenship is revoked), after which you can no longer appeal it.
    • Revocations by the Storting shall prevent the Monarch from granting Citizenship to them
    • There should be a procedure for the Storting to hear citizenship applications
    • Using the above, an individual may request to the Storting to either lift the revocation disability (the prevention of the Monarch to approve a citizenship request) and/or grant citizenship to them (If it's just citizenship then the disability from the initial revocation still applies and they would have to re-request the Storting for Citizenship if they lose it)
    • Perhaps if a person is granted citizenship, but is not allowed to gain citizenship by the Monarch, then the Storting must re-authorize their citizenship every few months?
    In the procedure that I've created, I ended up creating two separate procedures for both the Storting Accepting citizenship and dealing with people who have had their citizenship revoked.

    The former procedure merely occurs with an act declaring someone has citizenship now.
    The latter procedure is a bit more involved:
    • First the person has to transmit to the Speaker of the Underhusen and the Chairperson of the Overhusen their desire to have their status with the revocation change
    • Then the entire Storting has a joint-meeting (with Underhusen Procedural Rules), to discuss and debate this.
    • After a debate period the Storting can either vote to extend debate, to allow the monarch to be able to accept a citizenship request by a person, can grant citizenship, to dismiss the matter, or a combination of granting citizenship and removing the disability
    • Dismissal is if the Storting does believes that the original reasons for revoking citizenship have yet to change. Dismissal also prevents the person from refiling until the next session.
    • Granting Citizenship only grants citizenship to that person, but if they lose it they have to re-request it from the Storting. This is to be used in cases where the Storting believes that the reasons within the revocation are not as applicable, but the Storting still has concerns.
    • Lifting the Disability doesn't grant citizenship, but allows the Monarch to accept a Citizenship application from that person. This would, effectively, repeal the revocation, but defer the matter of actual citizenship to the Monarch. This would be used in cases where the Storting is sure that the reasons behind the revocation no longer apply, but that there still might be some issues that might need to be addressed.
    • Extending Debate is exactly what it says
    • Granting Citizenship and Lifting the Disability is a combination of both. This is used for cases where the Storting, is of the thought that the revocation is no longer necessary, and the person should become a full part of our community once again
    • The Storing may also add requirements or additional procedure to a revocation, along with change procedure entirely in a revocation. This could be used in situations where the Storting believes it necessary to take it to a vote of the Citizenry
    • Any motion just needs a simple majority vote of the entire Storting to pass
    • Any motion must be seconded by both a Skrifa and a Peer that did not introduce the motion

    It should remain the way it currently is, for the most part. So they can only be rescinded by the authority of the branch that issued them.
