I think it does open up a discussion, when/if the time comes when we can expand the human mind in a variety of digital ways, how will this look, and will we be afforded all the rights we deem necessary?

(sorry for the small intro I'll be back to most my in depth thoughts in a bit but I have to rush off)

I'm actually a long time subscriber of his, I was just thinking on this, found the video, and had the idea to ask about cognitive rights here glad I'm not the only one that enjoys his high quality content...

If we can truly build an artificial general intelligence (AGI) such that brain uploading is feasible, legal rights of digital minds would be the least of our worries, IMO. In all likelihood, the AGI would grow exponentially/feedback loop-ish/unpredictably (depending on what you believe) in an intelligence explosion, leading to superintelligence. The problem here is that we won't know when this would happen, and there's a big risk of AI destroying or severely harming humanity to achieve its task. The usual thought experiment is the paperclip maximizer: basically, an intelligent machine is told to make as many paperclips as possible and ends up taking apart the entire solar system and beyond to do so. The likely superiority of AGI over humans might even mean that we will be unable to compete with them and become extinct as a result.

Wait But Why (which is an excellent website; you guys should read basically all his posts too) did a two-part series on AI and the Singularity, which is the best introduction to the topic I've found so far.
