  • The Storting and the Monarchy are already court systems, even if they haven't been named such, dealing with many important what-ifs, so why not make it the most fair and orderly type of court-system possible? :P

    Just for interest's sake, how many appeals have there actually been?

    EDIT: And to add to my first paragraph, everytime a law gets made, that moves the region further into law, and by extension politics, and every time a law is changed or wide-scale reforms are suggested as are already being suggested by just about every campaigner in the current elections, that also changes the landscape of what the region is, even if it is in subtle ways, so trying to maintain a status-quo might go against the very nature of existence, as everything changes, all the time, and will continue to do so. The region already looks very differently from what I would imagine it looked like in the very beginning. So it might even be a pointless and losing battle to fight change.

    EDIT 2: If one looks at the world as a sentient species, politics become fairly unavoidable, as demonstrated by even very young children's grasp of the changing nature of the environment around them, and their realisation that they have to adapt with ever more creative means to keep up with nature and not be swept aside by it. I'm sounding a bit too philosophical now, but hopefully my main point of the inevitability of change is coming over well enough.

    EDIT 3: Oh, right, I forgot to link my little speech about change with court systems. It was partly in reply to your earlier question on my campaign page about your concerns for having an actual law student here and involved with the law and by extension politics, and partly to try to convey to you that you could give this a trial-run (the court of appeals thing) and see what happens and if it's as broken and inactive as you fear it might be, as a dynamic approach to a new situation. If it doesn't work, it can always be scrapped, and the old laws returned to power. It would consist only out of one person as I'm suggesting it, so if an active player gets chosen, then the inactivity concern gets lessened very much.

  • I maintain my view that court systems are inactive disasters in NationStates, especially when they're present as one Supreme Court branch. I've already posted the reasons why many times. :P

    For example, in the year and a half Wintreath has existed, nobody has ever had their Citizenship stripped of any reason other than their moving out of the region, renouncing Citizenship, or having their nation deleted for inactivity. We're really just looking at a what-if scenario, but an important what-if, nonetheless.

    You forgot to mention that it's one of the most hot button things on Wintreath alone that absolutely nobody can agree upon.  :P  We've seen acts for many types of court-types of systems as well as other alternatives, and nothing has ever passed.

  • I think the Storting does a fine job as a court system, I just think one extra impartial person would come in handy in certain cases.

    Hell, our court system in New Hyperion consists copletely out of the Inquisition and the Autarch (our form of the monarchy), and when they can't come to a decision, the decision is passed on to the Imperial Council (similar to the Riksrad), and it hasn't failed us as of yet. That's partly due to very clearly set up laws that seem to be prepared for any event, and the wisdom and impartiality of the Autarch himself. So that's why I tend not to see anything wrong with the Monarch handling both the revocation of citizenship and the reinstatement of it.

    But it would seem that there is a preference to have the Storting involved with much more in the region than in New Hyperion. Thus another thing I could propose is that citizenship should ONLY be revoked the Storting, and ONLY reinstated by the Monarch, the reasoning being that, as representatives of both the citizenry and the monarch, the Storting would attempt to serve the best interest of the people and the monarch when someone needs to get their citizenship revoked, and then the monarch can act as sole judge to determine whether the revocation was called for or not, and then decide whether he may feel inclined to give someone a second chance too.

    But it could also work the other way around, and that may indeed be more practical too, as the monarch can decide more quickly whether someone's citizenship needs to be revoked based on clear established laws, such as inactivity, and can make fairly uncontroversial decisions on his own. The Storting would then act as a Supreme Court of Appeal on its own, and as already pointed out, wouldn't get used in this capacity very often anyway.

    I can't truly see a problem that could arise with the latter system.

    As a note I would like to say the Storting has never had to deal with a case of any kind and at the moment the ability to accept cases and appeals is solely in the hands of the speaker.

    Also not everyone is in support of the Storting getting involved in more things. I prefer the powers of the monarch to increase, personally. I believe that there are more like me given the near and strangely failed.actions during this last term which were part of a plan rollout that would've moved the justice system's powers over to the monarch.
