    Do we have enough active citizens to have three full time judges, who would be expected to be independent?

    I believe we do. However, the Monarch is against a standing judiciary, the citizenry is against elected judges, and nobody likes using legislators as judges.

  • I would only see how we would need one full time judge that the monarch would appoint. In the event that a case were to arise against the appointed judge, or where the judge could not be independent, the monarch could appoint a new judge just for that case.

    I think the only way a vote could be used in terms of a judicial system would be a vote of no confidence in the judge, possibly needing to be passed by both the Underhusen and the Overhusen or something along those lines.

    That would be my initial idea anyway.

    It is certainly an interesting bill.

  • the thing is the monarch is against ANY form of standing judiciary from what I can tell, the closest being the bill that Wintermoot himself wrote and proposed (although I will note that I am against that bill as I disagree in the fact that it would still have no standing judiciary, which I view it as having, but that's my own opinion and belief)

    However the thing is due to the Monarch being opposed to any amendments that create a standing judiciary and the fact that he has stated he opposes this bill means that the Fundamental Laws CAN'T be amended at all, because of the Fundamental Laws Article VII section 1 and Section 3. They state that the Winter Nomad (Wintermoot) must Consent, and the Monarch(Wintermoot) must approve the amendment. Since wintermoot does not consent nor does he approve of said amendment, the Fundamental Laws can't be amended.

    Essentially no matter what, unless Wintermoot changes his mind suddenly, you can't create ANY form of standing Judiciary.

    How are else we supposed to do a proper confidence vote?  People want to have a say but they don't want judges elected but appointed?  Dome feel differently,  it's getting confusing and I'm trying to use this bill to satisfy everyone :-/

    Gov any vote in NS is a popularity contest, even a confidence vote. Also you can't appease everyone with a bill thus this bill(if you were to try) would be a mess, also again this bill won't be able to even pass and become an amendment because of the aforementioned fact that Wintermoot won't allow it thus these debates are moot until he decides otherwise.
