    Title
      1. This shall be titled Fundamental Laws Amendment VI

    Amendments
      2. This shall amend Article III, and add section 3, which shall read:
"3. Upon the filing of a case to the Monarch on the matters of constitutionality of laws the Monarch shall select, at random, three Wintreath citizens, that have been in Wintreath for at least two months time, that shall act as Judges for the case."
      3. This shall amend Article III, section 2, which shall read:
“2. All trials and cases shall proceed along the procedures established by the Storting for both Courts separately.”
      4. This shall amend Article III, section 1, which shall read:
“1. Upon the filing and acceptance of cases within the Storting, on the matters of Civil Disputes, the Monarch shall select at random a Peer of the Overhusen and two Skrifa of the Underhusen to serve as judges. The Peer shall serve as Chief Judge, and the Skrifa shall serve as Associate Judges.”

I propose this as an alternative to Wintermoot's Amendment.

I have added text to try and fix a problem that Point pointed out.

  • As Wintermoot did this for his bill I shall present the benefits that my bill brings to the table:

    1) Unlike Wintermoot's Amendment this doesn't require any changes to the Judicial Offices Act (although it can be changed to fit the requirement of the Sorting outlining the procedures).

    2) This also stays within our current framework of doing the Judiciary.

    3) Much Like wintermoot this keeps the ad-hoc nature of our Judiciary in tact

    4) This address the concern of Conflict of Interests within the Current system by Separating cases about laws and regular Cases.

    5) It doesn't create an unnecessary position instead it allows anyone to be a potential Judge on cases that deal with the Constitutionality of laws.

  • Do we want random citizens, who may have joined the region yesterday, to be judges in a case of constitutional law?

Also, what if a Skrifa or a Peer has a conflict of interest?  There's currently no mechanism for dismissing potentially partial judges.

It would have to be in the code for proceedings which shall be defined by the Sorting.

  • WM's proposal has those provisions in the act. Any reason why it shouldn't be the case here?

  • This grammar thing. You have really gotta get with it.
It should be constructed like this.
"'Upon the filing of a case to the Monarch on the matters of constitutionality of laws the Monarch shall select, at random, three Wintreath citizens, that have been in Wintreath for at least two months time, that shall act as Judges for the case.'"
In the original there was no that and no at least. Also, if a number is under the amount of eleven you write it out, generally... Anyhoo. Without the at least it means that they have to have been there for EXACTLY two months time. And without the that it means absolutely nothing. It is not a reasonable sentence.
Face the facts of being what you are, for that is what changes what you are.
