1. Title and Purpose
1.1 This Act shall be titled the ‘Code of Criminal Laws’, with the purpose being to outline criminal actions and their punishments. The Author would like to thank Chanku for his work in laying the foundations of this Act.
2. Application of Punishments.
2.1 The provisions of this Act apply to actions committed only after the passage of this Act, and no citizen may be brought to trial for actions not illegal prior to this Act’s passage nor for actions not deemed illegal by this Act.
2.2 Trials will be carried out under the methodology outlined in the Judicial Offices Act.
3. Illegal actions and their Severity.
3.1 Actions may be defined as “Minor Crimes”, “Major Crimes” or “High Crimes”. Each division bears a different sentencing limit and contains different severities of criminal action.
4. Minor Crimes.
4.1 Minor Crimes include:
4.1.1 Attacking or attempting to attack an Ambassador’s image.
4.1.2 Disrupting or attempting to disrupt legal proceedings as outlined in the Judicial Offices Act.
4.2 Minor crimes may not result in the defendant being stripped of citizenship. Sentencing shall not strip the defendant of any positions.
5. Major Crimes.
5.1 Major Crimes include:
5.1.1 Posing as a delegate for Wintreath to another region without prior appointment.
5.1.2 Sharing your Wintreath nation with someone who did not register the account.
5.1.3 Committing an act of aggression towards another Wintreath resident.
5.1.4 Demanding information from another Wintreath resident either regarding personal matters or matters relating to accounts or holdings online.
5.1.5 Attempting to pervert the cause of justice by lying or presenting false evidence in a court case.
5.1.6 Releasing misinformation about another Wintreath resident during elections in attempts to damage their image.
5.2 Major crimes may not result in the defendant being stripped of citizenship. Sentencing may include a stripping of any or all positions in government, the civil service et cetera and a barring from applying to positions in the future, within a certain period.
6. High Crimes.
6.1 High Crimes include:
6.1.1 Committing an act of aggression against a member of the Riksråd, the Storting or the Royal Family.
6.1.2 Releasing information from a Ministry, from the Military or from the Storting without approval by the relevant authorities.
6.1.3 Aiding and abetting a region Wintreath is currently at war with.
6.1.4 Spreading misinformation about members of the Riksråd, the Royal Family or the Monarch directly.
6.1.5 Committing an act of Treason.
6.2 High crimes may result in the defendant being stripped of citizenship. Sentencing may include revocation of all positions in Wintreath, banning of accounts of the defendant and a ban on applying for any positions in the future.
7. Special Circumstances.
7.1 Understanding that the majority of the defence of our region falls in the hands of the Monarch, this Act allows the Monarch to, with evidence, impeach any citizen of Wintreath with due suspicion of wrong-doing.
7.2 The Monarch has the right to supercede the court process in extenuating circumstances such as war or invasion.
7.3 Justices presiding over a case are free to make RECOMMENDATION verdicts that include punishments outside of those defined by this Act, subject to Monarchical approval of the recommendations.
8. Statute of Limitation on this Act
8.1 Minor Crimes must be brought before the court within one (1) month of their occurrence.
8.2 Major Crimes must be brought before the court within one (1) month of their occurrence.
8.3 High Crimes must be brought before the court within three (3) months of their occurrence.
8.4 A citizen may only be retried for a crime they have previously been acquitted of if new evidence comes to light.
9. Definitions.
9.1 Aggression shall be defined as 'an act that causes harm, in any way or form' and includes blackmail, extorting and harassment.
9.2 Treason shall be defined as 'an act that directly harms Wintreath as a region, knowingly carried out' and includes sabotaging military actions, all forms of online illegal action (hacking) against Wintreath holdings, or directly going against the word of the Monarch.
