    Title

    1. This Act shall be cited as the Code of Criminal Law Act.

    Definitions

    2. Hacking: Gaining or attempting to gain access to forum moderation or administrative controls by force.

    3. Phishing: Gaining or attempting to gain forum controls or passwords by deception.

    4. Spamming: Any action undertaken by persons to waste space on forums or to cause forums to crash by putting strain on the forum's server.

    5. Off-site property: Any forum, website or other property that is not found on the NationStates website and is maintained by a NationStates nation, organization, or region.

    6. Crashing: Any action which could cause a forum to go out of service or lose information, including: deletion of posts, deletion of the forum, spamming content that violates the forum's terms of service, or any other act of this kind.

    7. Griefing: Any action which defaces, defames, or wrongfully displays information on Wintreath property, such the Regional Message Board.

    High Crimes

    7. There shall be no statute of limitations on the high crimes defined below:

    (a) Treason
    (i) Levying, attempting to levy, inciting others to levy, or attempting to incite others to levy war against Wintreath;
    (ii) Seizing, attempting to seize, knowingly inciting others to seize, or knowingly attempting to incite others to seize a position in any fashion other than a lawful election or appointment;
    (iii) Using, attempting to use, inciting others to use, or attempting to incite others to use the powers of any position not gained by a lawful election or appointment;
    (iv) Carrying out any of the above actions against any region or organization with which Wintreath maintains diplomatic relations.
    (v) Those convicted of Treason are liable to a maximum punishment of indefinite ban.

    (b) Sedition
    (i) Knowingly aiding, attempting to aid, inciting others to aid, or attempting to incite others to aid enemies of Wintreath in a time of war;
    (ii) Inciting or attempting to incite rebellion from within Wintreath or outside of it.
    (iii) Those convicted of Sedition are liable to a maximum punishment of indefinite ban.

    (c) Offsite Terrorism
    (i) Knowingly crashing, spamming, phishing, or hacking any off-site property belonging to any NationStates region, organization, or nation, or attempting to do so.
    (ii) Those convicted of Offsite Terrorism are liable to a maximum punishment of indefinite ban.

    (d) Vandalism of Proprty
    (i) Knowingly and purposefully damaging, griefing, or any way editing property of Wintreath (Jump points, Embassies, etc...) without permission of the Monarch.
    (ii) Those convicted of Vandalism of Property are liable to a maximum punishment of indefinite ban.

    Felonies

    8. There shall be a three month statute of limitations on the crimes defined below:

    (a) Release of Classified Information
    (i) Knowingly and maliciously releasing or distributing classified information that is deemed protected or confidential in relevant legislation or executive order, by any manner of communication, to a party who is not authorized to view such information.
    (ii) Those convicted of Release of Classified Information are liable to a maximum punishment of six month ban.

    (b) Administrative Abuse
    (i) Deleting or editing a post or topic without just cause;
    (ii) Deleting or editing a forum account, or the information contained within, without just cause;
    (iii) Accessing a member account other than one's own without permission or just cause;
    (iv) Editing any laws without proper authorization;
    (v) Altering or attempting to alter moderator or administrator logs;
    (vi) Refusing to submit administrator logs when a warrant is presented.
    (vii) Those convicted of Administrative Abuse are liable to a maximum punishment of three month ban and/or removal of administrative or moderation power with The Winter Nomad's approval.

    (c) Impersonation of a Government Official
    (i) Representing, attempting to represent, or claiming to represent Wintreath in any environment, domestic or foreign, without proper authority or given right.
    (ii) Those convicted of Impersonation of a Government Official are liable to a maximum punishment of three month ban.

    (d) Harassment
    (i) Creating circumstances in which an individual is made to feel rightfully vulnerable;
    (ii) Creating circumstances in which an individual is made to feel rightfully insecure;
    (iii) Creating circumstances in which an individual is made to feel rightfully intimidated;
    (iv) Impersonating another member of the NationStates community.
    (v) Those convicted of Harassment are liable to a maximum punishment of one month ban.

    (e) Threatening Conduct
    (i) Using threats, blackmail, or other similar threatening measures to cause damage to another’s sense of security or sense of dignity;
    (ii) Maliciously damaging or limiting the exercise of any person’s rights as guaranteed under the Constitution of Wintreath.
    (iii) Those convicted of Threatening Conduct are liable to a maximum punishment of one month ban.

    (f) Illegal Recruitment
    (i) Knowingly sabotaging or attempting to sabotage recruitment efforts by acting in any manner including:
    (ii) Sending unauthorized recruitment telegrams, or authorized telegrams with unauthorized edits;
    (iii) Recruiting from a region other than a Feeder or Sinker;
    (iv) Falsely asserting to have sent any amount of recruitment telegrams;
    (v) Those convicted of Illegal Recruitment are liable to a maximum punishment of one month ban.

    (g) Chronic Misdemeanors
    (i) Demonstrating continuous disregard for the law;
    (ii) Continually commiting Misdemeanor crimes.
    (iii) Those convicted of Chronic Misdemeanors are liable to a maximum punishment of two week ban in addition to any sentence(s) for the misdemeanor crime(s) committed.

    Misdemeanors

    9. There shall be a one month statute of limitations on the crimes defined below:

    (a) Defamation
    (i) Knowingly making false allegations about a person, by any manner of communication to a third party, that has the potential to injure the reputation of said person.
    (ii) Those convicted of Defamation are liable to a maximum punishment of two week ban.

    (b) Obscenity
    (i) Using, in excess, obscene or derogatory language;
    (ii) Making obscene gestures including but not limited to emoticons and images.
    (iii) Those convicted of Obscenity are liable to a maximum punishment of one week ban.

    (c) Obscene Profile Content
    (i) Using obscene, offensive, or inappropriate avatars;
    (ii) Posting obscene, offensive, or inappropriate hyperlinks;
    (iii) Posting obscene, offensive, or inappropriate profile content.
    (iv) Those convicted of Obscene Profile Content are liable to a maximum punishment of one week ban.

    (d) Spamming
    (i) Excessive or useless posting, except in areas designated for such posting;
    (ii) Excessive posting in such a way that it is disruptive in the context of the conversation, especially in governmental areas.
    (iii) Those convicted of Spamming are liable to a maximum punishment of one week ban.

    (e) Governmental Contempt
    (i) Posting in a government office in a manner deemed impolite or inappropriate;
    (ii) Posting in the Regional Assembly without invitation and/or in a manner deemed impolite or unparliamentary.
    (iii) Those convicted of Governmental Contempt are liable to a maximum punishment of three day ban.

    (f) Electoral Sabotage
    (i) Changing a vote, after the seven day voting period during an election for public office, as a public edit before the results have been publicized.
    (ii) The person who submitted their vote was the person who changed the vote.
    (iii) Those convicted of Electoral Sabotage are liable to a maximum punishment of one week ban.

    Criminal Records

    10. The Court must promptly maintain criminal records for all those accused and/or convicted of a crime, which must be easily accessible to the citizens of Wintreath.

    Clarification

    11. Nothing in this Act shall be construed to limit the power of The Winter Nomad to protect the forum from content that violates the terms of service established by the forum's host, as explicitly guaranteed by Section 41 of the Constitution of Wintreath.

    Severability

    12. If any provision of this Act becomes illegal, invalid, or unenforceable, that shall not affect the legality, validity, or enforceability of any other provision of this Act.

    In accordance with the amended procedural rules, Debate will be open for 48 hours. At the conclusion of this time, Skrifa may either motion to vote or extend debate. As usual, the Speaker may motion to expedite this bill.

  • I have a concern that Section 8; sub-section b and Section 9; Sub-section d, violate the Fundamental Laws of Wintreath, Article VI: Section 5. The section of the Fundamental Laws is as follows, "5. The Winter Nomad and all subordinate administrative officials shall also be responsible for the maintenance, organization, security, and technological development of all official Wintreath properties. No government official shall be empowered to make decisions in any of these areas."

  • I am withdrawing this proposal from the table, mainly due to the fact that I posted the wrong version of the bill. I had three different versions I had edited/typed. When it came time for me to go back to class I accidently posted the wrong one.
