Amending the Constitution

  • As wonderful as our discussions in the Convention have been, we're not going to create a perfect, flawless document that accounts for everything that may happen in the future. We need a process to amend the Constitution...here's what I have in mind.

    The Process
    As with all proposals, a proposal to amend the Constitution would begin in the Underhusen, then move to the Overhusen. If it passed both chambers with 2/3 supermajority vote and obtained the consent of the Founder, it would go before the Citizens in an election. If 2/3 of the Citizens voted for it the Constitution would be considered amended.

    The founder part may seem strange compared to other Constitutions. It was part of the compromise to give the Underhusen a veto override over the Overhusen, but it makes sense in a way. In reality, all authorities and powers in a foundered region are invested with the Founder, and a Constitution is essentially a written agreement stating that the Founder is ceding some of those authorities to a regional government, establishing the social contract with the natives of the region. It only makes sense that the Founder authorizes changes to the agreement.

  • Sorry for my absence, I've been unable to use my computer due to a bitching virus that took a few days to clear out.


    I disagree strongly, there should be no prerequisite for a constitutional amendment to emerge from the legislature, it should be open-source so long as it gains, say, 10 signatory nations excluding the proposer. This way you'll eliminate any sort of complacency bias you get with current systems by including the citizenry in the process.

  • The problem with that is that there will come a time when it's fairly easy to get ten people supporting anything. The Underhusen is the voice of the people, and as with any legislation, any Citizen will be able to draft and propose an amendment. It's just formerly introduced in the Underhusen at the beginning of the process.

  • I see, so what's the mechanism to propose legislation as a Citizen? I'm guessing you need a sponsor from the Underhusen, which might be a way of restricting any influx of Citizen bills (if ever we get that).

  • I think a sponsor from the Underhusen is good enough if any citizenry wishes to propose an amendment.

    -Storting
    --Overhusen (only monarch & lords may post)
    --Underhusen (only Skrifa may post)
    --Stranger's Gallery (all citizens may post, we'll probably come up with a better name for the place. The citizens can post their thoughts on current Storting bills, and post draft legislation. When a Skrifa feels the bill is ready to be debated, they introduce it to the Underhusen to be debated & voted upon)

  • That seems a good set-up, but I agree with the different name for Stranger's Gallery haha.
    It's just the one I went for since that's the name or it in the RL UK Parliament.
