Decree 010 of the Monarch of Wintreath
Regarding the Delegacy of Wintreath

Historically, the Delegacy of Wintreath has been appointed by the Monarch as all members of the Riksråd are, an arrangement which made perfect sense when only the Delegate and the Founder could hold authority over the region. However, with the Founder now able to delegate regional authorities to others, and during a year in which many regional norms have been reevaluated and reconsidered, it makes sense to open the Delegacy to those who can demonstrate their interest in leading our World Assembly affairs to their fellow Citizens, as an experiment with the hopes of giving a historically insignificant position a newfound prominence.

Therefore, we make this decree which allows for election of the Delegate, while also preserving the rights and authorities granted to the Monarchy by the Fundamental Laws.

Election of the Delegate
1) Delegate elections shall begin on the first day of the months of December, March, June, and September, and run for three days. Any person who has been a Citizen for at least 60 days shall be eligible to stand for election to Delegate, and all Citizens who maintain a NationStates nation shall be eligible to vote for Delegate. Elections shall follow the optional preferential voting system, and the results determined by instant runoff.

Any person who has been a Citizen for at least 60 days, maintains a NationStates nation, and is able to join the World Assembly on that nation shall be eligible to stand for election to Delegate. All Citizens who maintain a NationStates nation shall be eligible to vote for Delegate. Elections shall follow the optional preferential voting system, and the results determined by instant runoff.
a) The 60 day requirement is waived for the June 2017 Delegate election.

2) In the event the position becomes vacant, a special election shall be called to fill the vacancy, composing of three days of nominations and campaigning followed be three days of voting.

Authorities and Responsibilities of the Delegate
3) The Delegate shall have the authority to determine their World Assembly votes, which carries the weight of their endorsers; and shall be enabled to determine the method of determining this vote as they see fit.

4) The Delegate shall build and maintain the highest number of endorsements in the region, taking action to ensure that they are endorsed by as many World Assembly nations as possible.

5) The Delegate shall represent Wintreath in communications regarding the World Assembly, unless it would be more appropriate for the Monarch to do so.

Reaffirmation of Constitutional Privilege
6) As per Article II Section 2 of the Fundamental Laws, the Monarch may modify or repeal these authorities on either an ad-hoc basis or through modification of this Decree. As per Article II Section 5 of the Fundamental Laws, the Monarch may dismiss the elected delegate at his or her discretion.

Modification of the Decree
7) The Monarch may modify this decree at any time, and shall notifiy the regional community of doing so by creating a new post in the topic in which the decree was published detailing the modifications made.

There are a few changes from the draft version we discussed here (http://wintreath.com/forums/index.php?topic=3820.0).

With the new law allowing for Citizenship without involvement in NS, I made it so that only Citizens maintaining a nation can vote for Delegate since it is a NS-centric position. I considered having the actual voting happen on the region page using polls, but after looking at the poll options I felt like there was no way to completely prevent the possibility of outside forces influencing the election...for example by moving WA nations into the region to vote. I even considered only allowing nations that had been in the WA and in the region for at least a month, but felt that was unfair to Citizens who had their WA nations elsewhere. Hopefully in the future NS administration adds other options that would make an election by polling more secure.

I also changed the procedure for filling a vacancy to holding a quick special election. After considering the matter I felt that going around asking past candidates if they still wanted the job would be a bit tedious, and chances are we would end up having special elections anyways.

@Wintermoot I have a quick question it says the election will begin in first day of December does that me citizens of Wintreath can campaign soon before the election?

It will be opened up at the same time as Underhusen elections.

I slightly modified section 1. When creating the nominations topic, I realized that I required that voters maintain a NS nation, but not the candidates themselves, which would obviously be problematic for this particular position.

Suggestion: the maintained NS nation should reside in Wintreath.

I have added a section to section 1 of this decree, waiving the 60-day requirement. While I generally believe the requirement serves the purpose of making sure a Citizen has properly integrated into the community before assuming such responsibility, I understand that this election is unique because we are attempting to rebuild interest in the delegacy from scratch while at the same time recruiting many newer nations into the region.

This waiver is only for the upcoming Delegate election, although I may consider shortening the requirement for future elections.
